California Privacy Rights Notice

This notice describes how M&M Helton Enterprises, LLC ("the Company," "we," "us," "our"), the owner and operator of hotprospector.com, collects, uses, and discloses the personal information of California residents, and the rights you may have under California privacy law. This notice is not legal advice. Please consult a qualified attorney if you need guidance on how California privacy law may impact your business.

1. APPLICABLE LAW

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA"), provides California residents with specific rights regarding their personal information. The CPRA amendments took full effect on January 1, 2023, and are enforced by the California Privacy Protection Agency (CPPA) and the California Attorney General.

2. WHO DOES THE CCPA APPLY TO?

The CCPA applies to for-profit businesses that collect personal information of California residents and meet any of the following thresholds:

  • Have gross annual revenue exceeding $25 million.
  • Buy, receive, sell, or share the personal information of 100,000 or more consumers or households (updated from 50,000 under the CPRA amendments).
  • Derive 50% or more of annual revenue from selling or sharing personal information.

A business does not need to be physically located in California for the CCPA to apply. "Personal information" is broadly defined to include information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.

3. THE COMPANY'S ROLE AS A SERVICE PROVIDER

The Company operates hotprospector.com, a platform through which our customers conduct outbound and inbound communications, including voice calls, text messages, emails, ringless voicemails, and AI-powered interactions with their business contacts.

With respect to personal information that our customers upload, store, or process through the platform (such as lead data, call recordings, transcripts, and contact information), the Company acts as a "service provider" under the CCPA. This means:

  • Our customers remain the controllers of their contacts' personal information.
  • We process that personal information only as necessary to provide our services or as instructed by our customers.
  • We do not sell or share our customers' contact data for our own commercial purposes.
  • We do not use customer contact data for any purpose other than providing and improving the Service, except as permitted or required by law.

4. CALIFORNIA CONSUMER RIGHTS

Under the CCPA, California residents have the following rights with respect to their personal information:

  • Right to Know: You have the right to request that a business disclose the categories and specific pieces of personal information it has collected about you, the sources of that information, the business purposes for collection, and the categories of third parties with whom the information has been shared.
  • Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions.
  • Right to Correct: You have the right to request correction of inaccurate personal information (added under CPRA).
  • Right to Opt Out of Sale or Sharing: You have the right to opt out of the "sale" or "sharing" of your personal information. Under the CPRA, "sharing" includes disclosing personal information for cross-context behavioral advertising purposes.
  • Right to Limit Use of Sensitive Personal Information: You have the right to limit the use and disclosure of sensitive personal information to purposes necessary to provide the services you requested (added under CPRA).
  • Right to Non-Discrimination: A business may not discriminate against you for exercising any of your CCPA rights.

5. HOW TO EXERCISE YOUR RIGHTS

If You Are NOT a hotprospector.com Customer

If you received a communication (call, text, email, or voicemail) from a business using the hotprospector.com platform, that communication came from one of our customers, not from the Company. Communications bearing "Powered by Hot Prospector" or originating through our platform are initiated and controlled by our customers.

To exercise your California privacy rights, you must contact the business that sent you the communication. Look at the name of the business, caller ID, or email address from which the communication originated.

As a service provider, the Company is obligated by law to handle personal information only upon the instructions and authorization of our customers. We cannot fulfill individual consumer requests related to data that our customers control. If you are unable to identify the business that contacted you, please reach out to us at support@hotprospector.com and we will make reasonable efforts to direct you to the appropriate party.

If You ARE a hotprospector.com Customer

If you have a current hotprospector.com account, are a California resident, and wish to exercise your rights under the CCPA, you may do so by:

  • Submitting a request through your account settings, or
  • Contacting us at support@hotprospector.com with the subject line "CCPA Rights Request."

We will verify your identity before processing any request. We will respond to verifiable consumer requests within 45 days, as required by law. If additional time is needed, we will notify you of the extension and the reason.

If You Are a Former Customer or Prospective Customer

If you are a California resident and a former hotprospector.com customer, or if you received communications from us about becoming a customer:

  • To stop receiving marketing communications from us, click the unsubscribe link in any email we sent you.
  • To exercise your CCPA rights regarding personal information we hold about you directly, contact us at support@hotprospector.com with the subject line "CCPA Rights Request."

6. PERSONAL INFORMATION WE COLLECT

When you use hotprospector.com as a customer, we may collect the following categories of personal information:

  • Identifiers: Name, email address, phone number, mailing address, IP address, account credentials.
  • Commercial Information: Subscription history, billing records, transaction history, service usage data.
  • Internet/Electronic Activity: Log data, browser type, pages visited, feature usage, session data.
  • Professional Information: Company name, job title, industry.
  • Audio/Visual Information: Call recordings and voicemails (as initiated and controlled by you through the platform).
  • Inferences: Usage patterns, preferences, and account activity derived from the above.

7. HOW WE USE PERSONAL INFORMATION

We use personal information for the following business purposes:

  • Providing, maintaining, and improving the hotprospector.com platform and services.
  • Processing payments and managing accounts.
  • Communicating with you about your account, service updates, and support.
  • Ensuring platform security and preventing fraud.
  • Complying with legal obligations and responding to lawful requests.
  • Improving our AI features using anonymized and aggregated data.

8. DISCLOSURE OF PERSONAL INFORMATION

We may disclose personal information to the following categories of recipients for business purposes:

  • Service providers who assist in operating the platform (cloud hosting, payment processing, telecommunications carriers, AI model providers).
  • Law enforcement and government agencies in response to valid legal process or as required by law.
  • Professional advisors such as attorneys and auditors as necessary.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising purposes.

9. DATA RETENTION

We retain personal information for as long as your account is active or as needed to provide the Service. Upon account cancellation, personal information may be retained for up to ninety (90) days, after which it may be permanently deleted. We may retain certain information longer as required by law, for legitimate business purposes, or to resolve disputes.

10. CUSTOMER OBLIGATIONS UNDER THE CCPA

If you are a hotprospector.com customer and qualify as a "business" under the CCPA, you are responsible for:

  • Providing appropriate privacy notices to your contacts and customers.
  • Obtaining all required consents for the collection, use, and disclosure of personal information.
  • Responding to consumer rights requests from your contacts regarding data you control.
  • Ensuring that your use of the platform complies with the CCPA and all applicable privacy laws.
  • Including appropriate service provider terms in any agreements with your own clients if you operate Sub-Accounts or white-label the platform.

The Company's role as a service provider does not relieve you of your own obligations under the CCPA.

11. CHANGES TO THIS NOTICE

We may update this notice from time to time to reflect changes in law, our practices, or the features of our platform. Material changes will be communicated via email or in-platform notification. Your continued use of the Service after the effective date of any update constitutes acceptance.
