Phone Call and Communications Policy

YOUR COMPANY, ORGANIZATION, AND/OR END USER IS LIABLE FOR ALL CALLS, TEXT MESSAGES, VOICEMAILS, AND OTHER COMMUNICATIONS ORIGINATING FROM YOUR ACCOUNT AND ANY SUB-ACCOUNTS UNDER YOUR CONTROL.
By accessing or using hotprospector.com, you acknowledge that you have read, understood, and agree to this Phone Call and Communications Policy. This Policy is supplemental to and governed by the hotprospector.com Terms and Conditions of Service. In the event of a conflict, the Terms and Conditions shall prevail.
1. PURPOSE AND SCOPE
It is the intention of M&M Helton Enterprises, LLC ("the Company") and its customers to maintain the highest standards of compliance and ethical conduct in all outbound and inbound communications. This Policy applies to all voice calls, text messages (SMS/MMS), ringless voicemails (RVM), AI-powered calls, AI-powered text messages, and any other communications initiated through the hotprospector.com platform, including communications initiated by Sub-Accounts or white-label users.
2. CUSTOMER RESPONSIBILITY AND LIABILITY
You, the subscriber and user of hotprospector.com, are solely and fully responsible for how you use the platform. This includes all communications initiated by you, your agents, your employees, your AI agents, and any Sub-Account users operating under your account. You agree to comply with all applicable federal, state, local, and international laws and regulations governing telecommunications, telemarketing, and electronic messaging.
IN NO EVENT WILL THE COMPANY BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE LOSS OR DAMAGE OF ANY KIND, INCLUDING LOST PROFITS (WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES) BY REASON OF ANY ACT OR OMISSION IN ITS PERFORMANCE. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
3. COMPLIANCE OBLIGATIONS
As a subscriber and user of hotprospector.com, you agree to the following:
3.1 Legal Awareness
- You will familiarize yourself with all applicable federal, state, and local laws before launching any call, text message, or voicemail campaign.
- You will ensure the platform is used in full compliance with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the CAN-SPAM Act, FCC regulations, and A2P 10DLC requirements.
- You will consult with a qualified attorney or compliance resource if you are uncertain about the legality of any campaign.
3.2 Calling and Texting Hours
- You will adhere to all federal and state permitted calling and texting time windows, including accounting for the time zone of the recipient, not just your own location.
- You will utilize the platform's built-in timezone enforcement and calling hour restriction features to prevent out-of-hours communications.
3.3 Consent and Prior Permission
- You will obtain all required prior express written consent before placing telemarketing calls or sending text messages to wireless numbers, as required by the TCPA and FCC rules (including the one-to-one consent requirement effective January 2026).
- You will not send pre-recorded sales messages to recipients with whom you do not have a qualifying business relationship and from whom you have not received permission to call.
- You will not send unsolicited text messages to recipients with whom you do not have a qualifying business relationship and from whom you have not received permission to send text messages.
- You will not send unsolicited communications to recipients who will incur charges unless proper prior consent has been obtained.
- You will maintain records of all consents and produce them upon request.
3.4 Do-Not-Call Compliance
- You will scrub all calling and texting lists against the National Do Not Call Registry and all applicable state do-not-call lists before launching any campaign.
- You will immediately place any person requesting Do Not Call (DNC) status on your internal DNC list using the platform's built-in DNC features.
- You will maintain your own internal DNC list in addition to using the platform's DNC management tools.
- You understand that honoring removal requests and avoiding calls to those who do not wish to be contacted is essential to responsible campaign management and legal compliance.
3.5 Caller Identification
- You will provide accurate and legally compliant caller ID information on all outbound calls.
- You will clearly identify the caller at the beginning of each call and provide proper contact information (including phone number and physical address) as required by applicable law.
- You will comply with all STIR/SHAKEN attestation and caller ID authentication requirements.
3.6 Prohibited Communications
- You will NOT send calls or messages to emergency telephone lines (911), hospitals, fire departments, law enforcement agencies, poison control centers, or other life-safety and utility service numbers.
- You will NOT engage two or more telephone lines of a multi-line business simultaneously.
- You will NOT use the platform to transmit threatening, abusive, harassing, defamatory, or fraudulent communications.
- You will NOT spoof caller ID information for deceptive or unlawful purposes.
3.7 AI-Powered Communications
- You are responsible for all actions taken by AI voice agents and AI SMS agents operating through your account.
- You will review and approve all AI agent configurations before deployment.
- You will disclose to recipients when they are communicating with an AI agent, where required by applicable law.
- You will monitor AI agent performance and immediately disable any AI agent producing non-compliant or inaccurate communications.
4. COMPANY PRACTICES
The Company does not initiate calling or messaging campaigns of its own on behalf of customers. The Company provides the platform and tools; all campaign decisions, content, data, and execution are the sole responsibility of the customer.
The Company will process any DNC requests received by our organization that were intended for our customers or resellers, so as not to further inconvenience the call or message recipient.
The Company reserves the right to immediately suspend or terminate any account that violates this Policy, applicable law, or the Terms and Conditions, without prior notice or refund.

6. CONSUMER DO NOT CALL REQUESTS
If you would like to add your number to the National Do Not Call Registry, you may do so by calling 1-888-382-1222 or online at www.donotcall.gov.
If your number is on the National Do Not Call Registry and you received a call or text message from someone using the hotprospector.com platform, please contact us by submitting a request at hotprospector.com so we can investigate and address the issue. Please include as much detail as possible, including the caller ID information, date and time of the call or message, and the content or offer presented.
7. ENFORCEMENT
ANY BREACH OF THIS POLICY IS CAUSE FOR IMMEDIATE SUSPENSION OR TERMINATION OF SERVICE, WITHOUT REFUND.
The Company retains records of all communications initiated through the platform and may make this information available to the FCC, FTC, state attorneys general, law enforcement, and other authorities in response to valid legal process or regulatory inquiry.
8. AGREEMENT
By using the hotprospector.com platform, you confirm that you have read, understood, and agree to this Phone Call and Communications Policy. This Policy should be read in conjunction with the hotprospector.com Terms and Conditions of Service, which contain additional provisions regarding liability, indemnification, arbitration, and other important terms.
